Fundraising Terms and Conditions

These terms apply to any individual, school, community group, organisation, business, or other entity ("Fundraiser") undertaking a fundraising activity in support of Dymocks Children's Charities Limited ("DCC”).

Dymocks Children's Charities welcomes and encourages community fundraising activities that support our mission of helping children develop literacy skills and a lifelong love of reading.

These Terms set out the responsibilities of both DCC and the Fundraiser and are designed to ensure fundraising activities are conducted in a lawful, safe, ethical, and transparent manner.

Approval of Fundraising Activities

All fundraising activities conducted in support of DCC must be approved by DCC before they are promoted or undertaken.

DCC reserves the right to approve, decline, suspend, or withdraw approval for any fundraising activity at its sole discretion.

Fundraising activities may be declined or withdrawn if DCC reasonably believes they:

  • Are inconsistent with the values, mission, or objectives of DCC;

  • May damage the reputation of DCC;

  • Are unlawful, unsafe, or misleading;

  • Present an unacceptable financial, legal, or reputational risk; or

  • Do not comply with these Terms and Conditions.

Responsibilities of the Fundraiser

The Fundraiser agrees to:

  • Conduct all fundraising activities in an ethical and responsible manner.

  • Comply with all applicable laws, regulations, permits, licences, and local council requirements.

  • Ensure all fundraising communications accurately represent DCC and the purpose of the fundraiser.

  • Conduct fundraising activities in a way that protects the reputation and goodwill of DCC.

  • Obtain any approvals, permits, licences, or insurance required for the fundraising activity.

  • Ensure the safety and wellbeing of all participants, volunteers, and members of the public.

  • Promptly notify DCC of any material changes to the fundraising activity.

  • Keep accurate financial records relating to the fundraising activity.

  • Provide fundraising records or supporting documentation to DCC if reasonably requested.

The Fundraiser must not engage in any activity that could be considered misleading, deceptive, offensive, discriminatory, or otherwise inappropriate.

Use of DCC Name, Logo and Branding

DCC's name, logo, trademarks, and other intellectual property remain the property of DCC.

Fundraisers may only use DCC branding with prior approval from DCC and in accordance with any branding guidelines provided.

Fundraisers must not:

  • Alter or modify DCC logos or branding;

  • Represent themselves as employees, agents, or official representatives of DCC;

  • Enter into contracts or agreements on behalf of DCC; or

  • Suggest that DCC has organised, managed, or endorsed a fundraising activity beyond its role as beneficiary unless expressly authorised.

DCC may withdraw permission to use its branding at any time.

Handling and Remittance of Funds

All funds raised in the name of DCC must be handled responsibly and transparently.

The Fundraiser agrees to:

  • Ensure all funds collected are accurately recorded.

  • Keep fundraising proceeds separate from personal or business funds where practical.

  • Remit fundraising proceeds to DCC within fourteen (14) days of the fundraising activity concluding, unless otherwise agreed in writing.

  • Provide details of income and expenses relating to the fundraising activity if requested by DCC.

Any expenses incurred in conducting the fundraising activity are the responsibility of the Fundraiser unless otherwise agreed by DCC.

Fundraisers must not deduct expenses from funds raised unless prior approval has been provided by DCC.

Photography, Media and Promotion

With appropriate consent, DCC may use photographs, videos, testimonials, stories, names, and fundraising achievements for promotional, marketing, reporting, fundraising, and educational purposes.

Where photographs or content include children, Fundraisers are responsible for ensuring appropriate consent has been obtained before providing content to DCC.

Liability

Fundraisers conduct fundraising activities at their own risk.

DCC is not responsible for:

  • The planning, organisation, or management of a fundraising activity;

  • Personal injury, loss, or damage suffered by participants;

  • Financial losses associated with fundraising activities; or

  • Any claims arising from the conduct of the fundraiser.

To the maximum extent permitted by law, DCC excludes all liability arising from or connected with a fundraising activity conducted by a Fundraiser.

Nothing in these Terms excludes any rights that cannot be excluded under Australian law.

Cancellation or Withdrawal

DCC reserves the right to withdraw support for or approval of any fundraising activity at any time.

If approval is withdrawn, the Fundraiser must immediately cease using DCC branding, logos, promotional materials, and references to the fundraising activity unless otherwise agreed by DCC.
